I can't believe that a major metropolitan paper like the LA Times would publish drivel like your distortion-laden column I had the misfortune to read today.
The citizens of Arizona passed a law that makes it necessary to prove you are in their state LEGALLY. They are tired of paying TWO BILLION taxpayer dollars a year in medical and educational benefits to people in their state ILLEGALLY.
They are tired of the Mexican drug traffickers, kidnappings (389 last year), traffic accidents, and crime caused by ILLEGAL immigrants in their state. They are tired of citizens of a foreign country overcrowding and bankrupting their emergency rooms and schools.
They have the ABSOLUTE RIGHT to defend their state when the federal government fails to do so just like I have the right to put three hollow-points in the chest of the guy who's trying to kick in my front door when the cops don't show up.
It has been the law in this country since 1940 that foreign nationals be able to produce proof that they are here LEGALLY by way of visa, green card, etc. This "Produce your papers" and the allusions to Nazi Germany is a bunch of dishonest claptrap.
If you took time to read the Arizona law (assuming you can read English) you would see that police officers may only inquire as to an individuals immigration status in the course of a "legal contact".
The problem with you and Mexicans like you is the fact that you have this sense of entitlement that you can enter OUR COUNTRY as you please.
You come from a culture and a country with no respect for the law or the rule of law. The United States is a sovereign nation with the ABSOLUTE RIGHT to decide who does and does not enter our country.
What amuses me the most is the fact that if our illegal immigration problem was due to the influx of SWEDES, you wouldn't have written ONE WORD in the defense of their rights. It is only because they are Hispanics like you that you leap to their defense.
I find it ironic that you are truer to your Hispanic roots than you are to your American citizenship, especially since the Hispanic culture is a broke-dick, busted-ass, ignorant-ass, uneducated, going-nowhere culture and has been for the last 500 years, and in all likelihood, will be for the NEXT 500 years.
When I moved to California in 1969, Los Angeles was a clean prosperous city. Now it's broke under the weight of massive entitlements.
Now we need concertina wire to protect our freeway signs from Hispano-moron graffiti "artists'. What an enlightened culture you come from that believes that vandalizing anothers property is an art form.
Over 400 California families have lost loved ones to ILLEGAL immigrant murderers.
40% of the criminals incarcerated in our prisons at CALIFORNIA TAXPAYER EXPENSE, are ILLEGAL immigrants. Thank you so much for our overcrowded ERs, schools and freeways. Thanks also for the gangs and the drive-by shootings. In all fairness though, I like the tacos.
If I want to enter Mexico , France , England , Germany or ANY country on this earth, I need to produce a passport to do so. It's THEIR COUNTRY and I need to ask permission to do so.
HOW DARE you and your brethren think that they have some God-given right to flout our laws and come into our country of their own accord. You and people like you are the textbook example of why the fewer Mexicans we have in our country, the better our country will be.

HOLLAND FUNDING NEW YORK 9/11 SITE MOSQUE

One of my readers in the Netherlands filled me in on where some of the financing came from that the terror-tied Imam Rauf used to buy an historic landmark and demolish it to build an Islamic supremacist mega mosque at Ground Zero: the Christian Democrat party in Holland.
Insane.
I am sure that I can say that on behalf of the 3,75 million voters in the Netherlands for PVV (The centre-right political party from Geert Wilders) I offer you and your friends an apologies for our present christian (CDA) government.
This because they granted a million Euro ( US $ 1.290.000 ) to the American Society for Muslim Advancement (ASMA) from Imam Faisal Abdur Rauf who intends to build a mosque next to the grounds of the 9/11 massacre the killed over 3000 innocent people. Don't ask me why.
Geert Wilders himself demanded today in our House of Parliament from our CDA Minister of Foreign affairs:
"Do you acknowledge that it is absurd -just at Ground Zero- to build a mosque, and that this is also an insult to (the next of kin of) the victims of 9-11? If not, why not?
So the Netherlands are aware of these building plans. But we don't understand how the US-(local) government can be so ignorant about the symbolic value for Muslims to build an other house of worship to Allah, right there in front of this specific location.
Many of us are also aware of the many Moslem 'enclaves' that already exist in the USA and we admire your personal efforts to stop Ground Zero to become one too.

MISPLACED HYPOCRITICAL OUTRAGE - window into Barak Hussein Abdullah Obama (My Title)

TEHRAN, Iran – A Sunni insurgent group said it carried out a double suicide bombing against a Shiite mosque in southeast Iran to avenge the execution of its leader, as Iranian authorities Friday said the death toll rose to 27 people, including members of the elite Revolutionary Guard.
The insurgent group, Jundallah, has repeatedly succeeded in carrying out deadly strikes on the Guard, the country's most powerful military force — including an October suicide bombing that killed more than 40 people. The new attack was a sign that the group is still able to carry out devastating bombings even after Iran hanged its leader Abdulmalik Rigi and his brother earlier this year.
(Alan Note: Although Obama knew very well that the Mullah regime had tortured and murdered the first brother, head of the Baluchi Jondollah resistance movement, he pressured Pakistan to remove the second Rigi from a bhospital bed in Peshawar and seliver him by proivate jet to the Mullahs in Iran, who tortured the heck out of him and recently hanged him - or as some reports claim, his already torture-dead body).
Shiite worshippers were attending ceremonies marking the birthday of the Prophet Muhammad's grandson, Hussein, when the first blast went off at the entrance of the mosque in the provincial capital Zahedan. The male bomber was disguised as a woman, local lawmaker Hossein Ali Shahriari told the ISNA news agency.
Inside the mosque, a cleric was reading from the Quran in front of lines of faithful sitting cross-legged on the floor when the building suddenly shook from the blast and screams were heard from outside, according to footage taken at the time and aired on Iranian state TV.
As people rushed to help, the second explosion detonated 20 minutes later, causing the majority of the deaths and injuries, ISNA reported. The technique is often used by Sunni militants in Iraq to maximize casualties.
Members of the Guard were among the worshippers, particularly because the ceremonies coincided with Iran's official Revolutionary Guard Day. The deputy interior minister, Ali Abdollahi, told the Fars news agency Thursday that several Guard members were among the dead.
Health Minister Marzieh Vahid Dastagerdi told ISNA on Friday that the toll stood at 27 dead but could still rise, with another 270 injured, including 11 in serious condition.
Iran accuses the United States and Britain of supporting Jundallah in a plot to weaken Tehran clerical leadership, a claim both countries deny. On Friday, officials blamed them for the latest attack.
Gen. Hossein Salami, deputy head of the Revolutionary Guard, told worshippers at the main weekly prayers in Tehran that the victims "were martyred by hands of mercenaries of the U.S. and U.K."
He was echoed by influential lawmaker Alaeddin Boroujerdi who said "America should be answerable for the terrorist incident in Zahedan."
President Obama condemned the attacks as OUTRAGEOUS, saying in a statement that the deaths of innocent civilians in their place of worship is an "intolerable offense" and that those responsible for the blasts must be held accountable.
(Alan Note: No such outrage against the targetted Mullahs for slaughtering thousands of dissenters in the streets and arresting and torturing/raping tens of thousands more throughout the Obama Administration period.
Was it because it was his Moslem namesake "Hussein" day and an affront to Obama?)
In New York, U.N. Secretary-General Ban Ki-moon strongly condemned the suicide bombings saying "this senseless act of terrorism at a place of worship makes it all the more reprehensible," U.N. associate spokesman Farhan Haq told reporters at U.N. headquarters.
Jundallah has been waging an insurgency for years in the remote Sistan-Baluchistan province, a lawless area where smuggling and banditry are rife. The groups says it is fighting for the rights of the mainly Sunni ethnic Baluchi minority, which it says suffers discrimination at the hands of Iran's Shiite's leadership. Iran has accused the group of links to al-Qaida, but experts say no evidence of such a link has been found.
Iran executed Jundallah's leader in June in Zahedan, a month after hanging his brother Abdulhamid Rigi, who had been captured in Pakistan in 2008 and extradited to Iran. The group named a new leader, al-Hajj Mohammed Dhahir Baluch.
In a statement posted on its Web site, Jundallah claimed responsibility for Thursday night's blast, saying they were to avenge Abdulmalik Rigi's death. It showed pictures of two suicide bombers wearing explosive vests, identified as Mohammad and Mujahid Rigi, apparently members of the leader's clan, though the site did not specify their relationship to him.
The group said its "sons of the faith ... carried out tonight a heroic unprecedented operation at the heart of an assembly of the Guard at Zahedan," claiming to have killed more than 100.
Jundallah has repeatedly targeted the Revolutionary Guards. In its deadliest attack, a suicide bomber hit a meeting between Guard commanders and Shiite and Sunni tribal leaders in the border town of Pishin on Oct. 18, killing 42 people, including 15 Guard members.
The group struck another mosque in Zahedan in May 2009, killing 25 people. In February 2007, a Jundallah car bomb blew up a bus carrying Revolutionary Guards in Zahedan, killing 11.

As Obama dithers about homeland security and presses on with a lawsuit against Arizona, the terrorists continue to plot this country's destruction. In a Daily News editorial dated July 11, 2010 there is a report that "Mexican authorities have rolled up a Hezbollah network being built in Tijuana, right across the border from Texas [sic] and closer to American homes than the terrorist hideouts in the Bekaa Valley are to Israel.
Surprise, surprise.
This is not the first time that firm evidence points to the infiltration of terrorists coming into the country.
According to a Kuwaiti newspaper, this "Hezbollah network aims to strike targets in Israel and the West." The triangulation of drug money from Mexican cartels and Iranian oil money are behind the financial strength of the terrorists.
Furthermore, "Hezbollah has shadowed the terrorist-sponsoring regime in Tehran, which has been forging close ties with Hugo Chavez of Venezuela, who in turn supports the narcoterrorist organization FARC, which wreaks all kinds of havoc throughout the region."
As Rick Moran has demonstrated, Obama is quite chummy with Chavez.
This president is giving the green light to terrorism with the nuanced words he makes, the actions he takes, and the positions he holds. The bombs are being loaded and aimed at our hearts and he and his Department of Justice ignore the danger to this country.

WHAT IS SHARIA?
What is Sharia?
Sharia law is Islamic law. Sharia is the basis for every demand that Muslims make on our society. When schools are asked to give up a room for Islamic prayer, that is asking us to implement Sharia law.
When a Muslim wears a head scarf, that is in obedience to Sharia law. When our newspapers would not publish the Danish Mohammed cartoons, our newspapers were submitting to the demands of Sharia law. When demands are made for our hospitals to treat Muslim women in special ways, that is Sharia.
When our textbooks have to be vetted by Muslim organizations before they are used in our schools, that is in accordance with Sharia law.
The attack on the World Trade Center was done in adherence to the rules of war, jihad, found in Sharia law. Sharia law is the basis for the religious, political and cultural life of all Muslims.
Sharia law is being implemented more and more in America and yet there is no knowledge about what Sharia actually is since public, private or religious schools do not teach it.
THE GOOD NEWS
The easiest way to learn about Islam is through Sharia law.
Through learning about Sharia you are introduced to the Koran and Mohammed in a practical manner. It is easy to learn when you can see the direct application and examples.
When you know Sharia, Islam suddenly makes sense, it all fits together. Most people think Islam is complicated or even impossible to understand, but when you understand its principles, Islam is very, very logical. It is based on different views of humanity, logic, knowledge, and ethics.
Once you understand the principles and logic, you not only can explain what and why something is happening, but you will be able to predict the next step in the process.
UNDERSTANDING THE REFERENCE NUMBERS
Before you can understand Sharia, you have to learn about three books that are the basis of Sharia.
Each ruling or law in Sharia is based on a reference in the Koran or the Sunna, the perfect example of Mohammed (found in two texts-Hadith and Sira). Each and every law in Islam must come from the Koran and the Sunna.
We know the Sunna by knowing about the personal details of Mohammed's life. We know how he cleaned his teeth and which shoe he put on first. We know the Sunna because we have the Sira and the Hadith.
You probably think that the Koran is the bible of Islam. Not true. The bible of Islam is the Koran, the Sira and the Hadith. These three texts can be called the Trilogy.
The Koran is a small part, only 14% of the total words, of the doctrine that is Islam. The text devoted to the Sunna is 86% of the total textual doctrine of Islam. Islam is 14% Allah and 86% Mohammed.
Sharia is nothing more than a condensation and extrapolation of the Koran and the Sunna.
Therefore, it is impossible to understand the Sharia without some understanding about the doctrine found in the Koran, Hadith and the Sira. Turn to any page after this chapter and you will find that most of the paragraphs have an index number.
The classic Sharia law text is the Reliance of the Traveller, N. Keller, Amana Publications. (Yes, the correct spelling is Traveller with a double l.) It is a 1,200 page book devoted to such subjects as: political control of non-Muslims, prayer, jihad, wills and estates, punishment, court rules, and land use. It covers legalities and theology.
Here is a typical paragraph:
08.0 APOSTACY FROM ISLAM
08.1 When a person who has reached puberty and is sane, voluntarily apostatizes from Islam, he deserves to be killed.
[Bukhari 9,83,17] Mohammed: “A Muslim who has admitted that there is no god but Allah and that I am His prophet may not be killed except for three reasons: as punishment for murder, for adultery, or for apostasy.”

Since the Sharia is nothing more than a codification of perfect, unchanging, universal texts, it is a perfect, unchanging and universal legal code.

Sharia law is Islamic law. Sharia is the basis for every demand that Muslims make on our society. When schools are asked to give up a room for Islamic prayer, that is asking us to implement Sharia law.
When a Muslim wears a head scarf, that is in obedience to Sharia law. When our newspapers would not publish the Danish Mohammed cartoons, our newspapers were submitting to the demands of Sharia law. When demands are made for our hospitals to treat Muslim women in special ways, that is Sharia.
When our textbooks have to be vetted by Muslim organizations before they are used in our schools, that is in accordance with Sharia law.
The attack on the World Trade Center was done in adherence to the rules of war, jihad, found in Sharia law. Sharia law is the basis for the religious, political and cultural life of all Muslims.
Sharia law is being implemented more and more in America and yet there is no knowledge about what Sharia actually is since public, private or religious schools do not teach it.
THE GOOD NEWS
The easiest way to learn about Islam is through Sharia law.
Through learning about Sharia you are introduced to the Koran and Mohammed in a practical manner. It is easy to learn when you can see the direct application and examples.
When you know Sharia, Islam suddenly makes sense, it all fits together. Most people think Islam is complicated or even impossible to understand, but when you understand its principles, Islam is very, very logical. It is based on different views of humanity, logic, knowledge, and ethics.
Once you understand the principles and logic, you not only can explain what and why something is happening, but you will be able to predict the next step in the process.
UNDERSTANDING THE REFERENCE NUMBERS
Before you can understand Sharia, you have to learn about three books that are the basis of Sharia.
Each ruling or law in Sharia is based on a reference in the Koran or the Sunna, the perfect example of Mohammed (found in two texts-Hadith and Sira). Each and every law in Islam must come from the Koran and the Sunna.
We know the Sunna by knowing about the personal details of Mohammed's life. We know how he cleaned his teeth and which shoe he put on first. We know the Sunna because we have the Sira and the Hadith.
You probably think that the Koran is the bible of Islam. Not true. The bible of Islam is the Koran, the Sira and the Hadith. These three texts can be called the Trilogy.
The Koran is a small part, only 14% of the total words, of the doctrine that is Islam. The text devoted to the Sunna is 86% of the total textual doctrine of Islam. Islam is 14% Allah and 86% Mohammed.
Sharia is nothing more than a condensation and extrapolation of the Koran and the Sunna.
Therefore, it is impossible to understand the Sharia without some understanding about the doctrine found in the Koran, Hadith and the Sira. Turn to any page after this chapter and you will find that most of the paragraphs have an index number.
The classic Sharia law text is the Reliance of the Traveller, N. Keller, Amana Publications. (Yes, the correct spelling is Traveller with a double l.) It is a 1,200 page book devoted to such subjects as: political control of non-Muslims, prayer, jihad, wills and estates, punishment, court rules, and land use. It covers legalities and theology.

YOUR TAX DOLLARS USED TO HUNT PEACEFUL IRANIAN DISSIDENTS IN USA
As if we needed another reason to be angry at the ongoing misuse of our taxpayer dollars, here is a candidate for most infuriating example of the year. A program partially funded by your tax dollars is being used to hunt down anti-regime Iranian dissidents. . . . in Los Angeles. At the behest of the terrorist President Mahmoud Ahmadenijad's regime, we allow Interpol to place Red Notices on heroes in America who seek peaceful change in Iran.
A huge Iranian immigrant community exists in Southern California. I have known a number of them and they are great folks. Many are ethnic minorities (e.g. Persian Jews, Christians or Zoroastrians) who rightly feared persecution by the zealous mullahs in Tehran. Others are political dissidents such as Monarchists who support the return of the Shah’s son, or supporters of building Democracy in Iran.
Not content to torture and murder such people at home, the odious Iranian regime is now using Interpol to compel dissidents to stay put and limit their freedom of movement overseas. In fact, if they travel to other nations they risk being arrested and turned over to the Islamic Republic of Iran.
A new Obama Presidential Order allows Interpol to act with few restraints on US soil. Iran is thrilled.
Executive Order Amended to Immunize INTERPOL In America

Thursday, December 17, 2009, The White House released an Executive Order “Amending Executive Order 12425.” It grants INTERPOL (International Criminal Police Organization) a new level of full diplomatic immunity afforded to foreign embassies and select other “International Organizations” as set forth in the United States International Organizations Immunities Act of 1945.
By removing language from President Reagan’s 1983 Executive Order 12425, this international law enforcement body now operates - now operates - on American soil beyond the reach of our own top law enforcement arm, the FBI, and is immune from Freedom Of Information Act (FOIA) requests.

ENJOY CERTAIN PRIVILEGES, EXEMPTIONS, AND IMMUNITIES
By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 1 of the International Organizations Immunities Act (22 U.S.C. 288), and in order to extend the appropriate privileges, exemptions, and immunities to the International Criminal Police Organization (INTERPOL), it is hereby ordered that Executive Order 12425 of June 16, 1983, as amended, is further amended by deleting from the first sentence the words “except those provided by Section 2©, Section 3, Section 4, Section 5, and Section 6 of that Act” and the semicolon that immediately precedes them.

After initial review and discussions between the writers of this analysis, the context was spelled out plainly.
Through EO 12425, President Reagan extended to INTERPOL recognition as an “International Organization.” In short, the privileges and immunities afforded foreign diplomats was extended to INTERPOL. Two sets of important privileges and immunities were withheld: Section 2© and the remaining sections cited (all of which deal with differing taxes).
And then comes December 17, 2009, and President Obama. The exemptions in EO 12425 were removed.
Section 2c of the United States International Organizations Immunities Act is the crucial piece.
Property and assets of international organizations, wherever located and by whomsoever held, shall be immune from search, unless such immunity be expressly waived, and from confiscation.
The archives of international organizations shall be inviolable.
Inviolable archives means INTERPOL records are beyond US citizens’ Freedom of Information Act requests and from American legal or investigative discovery (”unless such immunity be expressly waived.”
Property and assets being immune from search and confiscation means precisely that. Wherever they may be in the United States.
This could conceivably include human assets - Americans arrested on our soil by INTERPOL officers.
Context: International Criminal Court
The importance of this last crucial point cannot be understated, because this immunity and protection - and elevation above the US Constitution - afforded INTERPOL is likely a precursor to the White House subjecting the United States under the jurisdiction of the International Criminal Court (ICC). INTERPOL provides a significant enforcement function for the ICC, just as our FBI provides a significant function for our Department of Justice.
We direct the American public to paragraph 28 of the ICC’s Proposed Programme Budget for 2010 (PDF).
29. Additionally, the Court will continue to seek the cooperation of States not party to the Rome Statute and to develop its relationships with regional organizations such as the Organization of American States (OAS), the Arab League (AL), the African Union (AU), the Organization of the Islamic Conference (OIC), ASEAN and CARICOM. We will also continue to engage with subregional and thematic organizations, such as SADC and ECOWAS, and the Commonwealth Secretariat and the OIF. This will be done through high level visits, briefings and, as appropriate, relationship agreements. Work will also be carried out with sectoral organizations such as IDLO and INTERPOL, to increase efficiency.
The United States is not a party to the Rome Statute - the UN treaty that established the International Criminal Court. (See: Rome Statute of the International Criminal Court)President George W. Bush rejected subjecting the United States to the jurisdiction of the ICC and removed the United States as a signatory. President Bill Clinton had previously signed the Rome Statute during his presidency. Two critical matters are at play. One is an overall matter of sovereignty and the concept of the primacy of American law above those of the rest of the world. But more recently a more over-riding concern principally has been the potential - if not likely - specter of subjecting our Armed Forces to a hostile international body seeking war crimes prosecutions during the execution of an unpopular war.
President Bush in fact went so far as to gain agreement from nations that they would expressly not detain or hand over to the ICC members of the United States armed forces. The fear of a symbolic ICC circus trial as a form of international political protest to American military actions in Iraq and elsewhere was real and palpable.
President Obama’s words have been carefully chosen when directly regarding the ICC. While President Bush outright rejected subjugating American armed forces to any international court as a matter of policy, President Obama said in his 2008 presidential campaign that it is merely “premature to commit” to signing America on.
However, in a Foreign Policy in Focus round-table in 2008, the host group cited his former foreign policy advisor, Samantha Power. She essentially laid down what can be viewed as now-President Obama’s roadmap to America rejoining the ICC. His principal objections are not explained as those of sovereignty, but rather of image and perception.
Obama’s former foreign policy advisor, Samantha Power, said in an early March (2008) interview with The Irish Times that many things need to happen before Obama could think about signing the Rome Treaty.
“Until we’ve closed Guantánamo, gotten out of Iraq responsibly, renounced torture and rendition, shown a different face for America, American membership of the ICC is going to make countries around the world think the ICC is a tool of American hegemony.
The detention center at Guantánamo Bay is nearing its closure and an alternate continental American site for terrorist detention has been selected in Illinois. The time line for Iraq withdrawal has been set. And President Obama has given an abundance of international speeches intended to “show a different face for America.” He has in fact been roundly criticized domestically for the routinely apologetic and critical nature of these speeches.
President Obama has not rejected the concept of ICC jurisdiction over US citizens and service members. He has avoided any direct reference to this while offering praise for the ICC for conducting its trials so far “in America’s interests.” The door thus remains wide open to the skeptical observer.
CONCLUSIONS
In light of what we know and can observe, it is our logical conclusion that President Obama’s Executive Order amending President Ronald Reagans’ 1983 EO 12425 and placing INTERPOL above the United States Constitution and beyond the legal reach of our own top law enforcement is a precursor to more damaging moves.
The pre-requisite conditions regarding the Iraq withdrawal and the Guantanamo Bay terrorist detention facility closure will continue their course. meanwhile, the next move from President Obama is likely an attempt to dissolve the agreements made between President Bush and other states preventing them from turning over American military forces to the ICC (via INTERPOL) for war crimes or any other prosecutions.
When the paths on the road map converge - Iraq withdrawal, Guantánamo closure, perceived American image improved internationally, and an empowered INTERPOL in the United States - it is probable that President Barack Obama will once again make America a signatory to the International Criminal Court. It will be a move that surrenders American sovereignty to an international body who’s INTERPOL enforcement arm has already been elevated above the Constitution and American domestic law enforcement.
For an added and disturbing wrinkle, INTERPOL’s central operations office in the United States is within our own Justice Department offices. They are American law enforcement officers working under the aegis of INTERPOL within our own Justice Department. That they now operate with full diplomatic immunity and with “inviolable archives” from within our own buildings should send red flags soaring into the clouds.
This is the disturbing context for President Obama’s quiet release of an amended Executive Order 12425. American sovereignty hangs in the balance if these actions are not prevented through public outcry and political pressure. Some Americans are paying attention, as can be seen from some of the earliest recognitions of this troubling development here, here and here. But the discussion must extend well beyond the Internet and social media.
Ultimately, a detailed verbal explanation is due the American public from the President of the United States detailing why an international law enforcement arm assisting a court we are not a signatory to has been elevated above our Constitution upon our soil.

Many are ethnic minorities (e.g. Persian Jews, Christians or Zoroastrians) who rightly feared persecution by the zealous mullahs in Tehran. Others are political dissidents such as Monarchists who support the return of the Shah’s son, or supporters of building Democracy in Iran.
Not content to torture and murder such people at home, the odious Iranian regime is now using Interpol to compel dissidents to stay put and limit their freedom of movement overseas. In fact, if they travel to other nations they risk being arrested and turned over to the Islamic Republic of Iran.
A new Obama Presidential Order allows Interpol to act with few restraints on US soil. Iran is thrilled.
Executive Order Amended to Immunize INTERPOL In America

Thursday, December 17, 2009, The White House released an Executive Order “Amending Executive Order 12425.” It grants INTERPOL (International Criminal Police Organization) a new level of full diplomatic immunity afforded to foreign embassies and select other “International Organizations” as set forth in the United States International Organizations Immunities Act of 1945.
By removing language from President Reagan’s 1983 Executive Order 12425, this international law enforcement body now operates - now operates - on American soil beyond the reach of our own top law enforcement arm, the FBI, and is immune from Freedom Of Information Act (FOIA) requests.

By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 1 of the International Organizations Immunities Act (22 U.S.C. 288), and in order to extend the appropriate privileges, exemptions, and immunities to the International Criminal Police Organization (INTERPOL), it is hereby ordered that Executive Order 12425 of June 16, 1983, as amended, is further amended by deleting from the first sentence the words “except those provided by Section 2©, Section 3, Section 4, Section 5, and Section 6 of that Act” and the semicolon that immediately precedes them.

After initial review and discussions between the writers of this analysis, the context was spelled out plainly.
Through EO 12425, President Reagan extended to INTERPOL recognition as an “International Organization.” In short, the privileges and immunities afforded foreign diplomats was extended to INTERPOL. Two sets of important privileges and immunities were withheld: Section 2© and the remaining sections cited (all of which deal with differing taxes).
And then comes December 17, 2009, and President Obama. The exemptions in EO 12425 were removed.
Section 2c of the United States International Organizations Immunities Act is the crucial piece.
Property and assets of international organizations, wherever located and by whomsoever held, shall be immune from search, unless such immunity be expressly waived, and from confiscation.
The archives of international organizations shall be inviolable.
Inviolable archives means INTERPOL records are beyond US citizens’ Freedom of Information Act requests and from American legal or investigative discovery (”unless such immunity be expressly waived.”
Property and assets being immune from search and confiscation means precisely that. Wherever they may be in the United States.
This could conceivably include human assets - Americans arrested on our soil by INTERPOL officers.
Context: International Criminal Court
The importance of this last crucial point cannot be understated, because this immunity and protection - and elevation above the US Constitution - afforded INTERPOL is likely a precursor to the White House subjecting the United States under the jurisdiction of the International Criminal Court (ICC). INTERPOL provides a significant enforcement function for the ICC, just as our FBI provides a significant function for our Department of Justice.
We direct the American public to paragraph 28 of the ICC’s Proposed Programme Budget for 2010 (PDF).
29. Additionally, the Court will continue to seek the cooperation of States not party to the Rome Statute and to develop its relationships with regional organizations such as the Organization of American States (OAS), the Arab League (AL), the African Union (AU), the Organization of the Islamic Conference (OIC), ASEAN and CARICOM. We will also continue to engage with subregional and thematic organizations, such as SADC and ECOWAS, and the Commonwealth Secretariat and the OIF. This will be done through high level visits, briefings and, as appropriate, relationship agreements. Work will also be carried out with sectoral organizations such as IDLO and INTERPOL, to increase efficiency.
The United States is not a party to the Rome Statute - the UN treaty that established the International Criminal Court. (See: Rome Statute of the International Criminal Court)President George W. Bush rejected subjecting the United States to the jurisdiction of the ICC and removed the United States as a signatory. President Bill Clinton had previously signed the Rome Statute during his presidency. Two critical matters are at play. One is an overall matter of sovereignty and the concept of the primacy of American law above those of the rest of the world. But more recently a more over-riding concern principally has been the potential - if not likely - specter of subjecting our Armed Forces to a hostile international body seeking war crimes prosecutions during the execution of an unpopular war.
President Bush in fact went so far as to gain agreement from nations that they would expressly not detain or hand over to the ICC members of the United States armed forces. The fear of a symbolic ICC circus trial as a form of international political protest to American military actions in Iraq and elsewhere was real and palpable.
President Obama’s words have been carefully chosen when directly regarding the ICC. While President Bush outright rejected subjugating American armed forces to any international court as a matter of policy, President Obama said in his 2008 presidential campaign that it is merely “premature to commit” to signing America on.
However, in a Foreign Policy in Focus round-table in 2008, the host group cited his former foreign policy advisor, Samantha Power. She essentially laid down what can be viewed as now-President Obama’s roadmap to America rejoining the ICC. His principal objections are not explained as those of sovereignty, but rather of image and perception.
Obama’s former foreign policy advisor, Samantha Power, said in an early March (2008) interview with The Irish Times that many things need to happen before Obama could think about signing the Rome Treaty.
“Until we’ve closed Guantánamo, gotten out of Iraq responsibly, renounced torture and rendition, shown a different face for America, American membership of the ICC is going to make countries around the world think the ICC is a tool of American hegemony.
The detention center at Guantánamo Bay is nearing its closure and an alternate continental American site for terrorist detention has been selected in Illinois. The time line for Iraq withdrawal has been set. And President Obama has given an abundance of international speeches intended to “show a different face for America.” He has in fact been roundly criticized domestically for the routinely apologetic and critical nature of these speeches.
President Obama has not rejected the concept of ICC jurisdiction over US citizens and service members. He has avoided any direct reference to this while offering praise for the ICC for conducting its trials so far “in America’s interests.” The door thus remains wide open to the skeptical observer.
CONCLUSIONS
In light of what we know and can observe, it is our logical conclusion that President Obama’s Executive Order amending President Ronald Reagans’ 1983 EO 12425 and placing INTERPOL above the United States Constitution and beyond the legal reach of our own top law enforcement is a precursor to more damaging moves.
The pre-requisite conditions regarding the Iraq withdrawal and the Guantanamo Bay terrorist detention facility closure will continue their course. meanwhile, the next move from President Obama is likely an attempt to dissolve the agreements made between President Bush and other states preventing them from turning over American military forces to the ICC (via INTERPOL) for war crimes or any other prosecutions.
When the paths on the road map converge - Iraq withdrawal, Guantánamo closure, perceived American image improved internationally, and an empowered INTERPOL in the United States - it is probable that President Barack Obama will once again make America a signatory to the International Criminal Court. It will be a move that surrenders American sovereignty to an international body who’s INTERPOL enforcement arm has already been elevated above the Constitution and American domestic law enforcement.
For an added and disturbing wrinkle, INTERPOL’s central operations office in the United States is within our own Justice Department offices. They are American law enforcement officers working under the aegis of INTERPOL within our own Justice Department. That they now operate with full diplomatic immunity and with “inviolable archives” from within our own buildings should send red flags soaring into the clouds.
This is the disturbing context for President Obama’s quiet release of an amended Executive Order 12425. American sovereignty hangs in the balance if these actions are not prevented through public outcry and political pressure. Some Americans are paying attention, as can be seen from some of the earliest recognitions of this troubling development here, here and here. But the discussion must extend well beyond the Internet and social media.
Ultimately, a detailed verbal explanation is due the American public from the President of the United States detailing why an international law enforcement arm assisting a court we are not a signatory to has been elevated above our Constitution upon our soil.
